


Court Fees
Long Island Divorce Online will only charge you court fees at the rate imposed by the New York State Unified Court System. In other words, our service REFUSES to lie about the court fees required for the filing of a divorce action, and charges our clients fees set by the court, nothing more.
If you wish, you may verify these fees by visiting the New York State Unified Court System website detailing these fees.
All divorce actions require the following court fees: $210 for an index number, $95 for a Request for Judicial Intervention, $30 for a Note of Issue, and $5-15 for a Certified Copy of the Judgment of Divorce. If you are filing a Separation Agreement with your divorce, the court charges a $35 fee for the filing. For a more detailed explation of what each of the above items are, click here.
The only other 'administrative' fee required is $100 for the hiring of a professional process server to serve the divorce papers upon your spouse.

Our fees are based upon the amount of assistance and paperwork necessary to complete your action. Fees for divorce actions wherein the parties have minor children generally require more work than those for couples who do not have minor children, and therefore are charged at a higher rate.
Explanation of Court Documents Requiring a Court Fee
NY State Index Number = This fee gives your action an index number which is used by the courts to track your action. The index number that you are assigned will then appear on all papers filed in your action and will be unique to your action in the county where your divorce is filed. ($210.00 as set by NY CPLR, the procedural rules of New York State Courts)
Request for Judicial Intervention = The filing of a Request for Judicial Intervention (RJI) notifies the court that you would like to take an action that would require the court to ‘intervene’ or supervise. The RJI used for uncontested divorce actions notifies the court that you are filing a Note of Issue. ($95.00 pursuant to the NY CPLR)
Note of Issue = The Note of Issue informs the court that the action is ready to be decided by the court. ($30.00 pursuant to NY CPLR)
Separation Agreement / Stipulation of Settlement Filing Fee = The fee required to file your separation agreement with the court. You MUST file your Separation Agreement with the court in order to include the terms of the Agreement in your Judgment of Divorce.

Service of Process Fee = This fee is require for service of process upon the Defendant spouse. A ‘process server’ will deliver the Summons and Complaint to the Defendant’s home for personal delivery, and file an ‘Affidavit of Service’ with the court attesting to the person served. ($100.00)
Certified Copy of Judgment of Divorce Fee = Upon the completion of your divorce, you will want to have a Certified copy of your Judgment of Divorce (JOD) for purposes of changing your name, updating your financial records, for religious purposes and other matters requiring you to prove that your divorce has been completed. Each spouse receives one copy.
(2 multiplied by $5.00 (up to four pages) and $1.25 for each page after the fourth)
(Example = 6 page Judgment of Divorce = $5.00 + 2(1.25) = $7.50 per copy)
